Alert | I for one am fed up with the constant problems with the pool. Today the pool will be shut down due to someone pooping in it again!!! We went to the pool to swim and we were greeted by people coming out telling us that someone pooped in it. I along with many other residents in the community have contacted the HOA on numerous occasions and have gotten nowhere. They have since passed off the responsibility tothe builder and the builder passes it back on to the HOA. We pay almost $100 a month in HOA fees!!!!!!!! We should be able to swim in the pool whenever we want and not have to worry about people that don't live here vandalizing it. If anyone else out there is annoyed like me, then you should call Deborah, the lady that runs the HOA. Flood her with phone calls and maybe they will finally build up on the gates so that only the Dessert passage residents can enjoy the pool. | | | |

Alert | | wow!! we have clogged toliets, pool furniture thrown in the pool, locks broken, etc and now pooping in our pool. What is sad is our HOA is aware of the problems and they don't do anything. We recently received a letter from our HOA introducing themselves and telling us about the vandalism around our community and pool. Is this their way or telling us our dues might be going up?? Alert | | Well maybe if they cleaned the bathrooms this wouldn't happen. I assume it was a kid and those bathrooms are absolutely horrible! My daughter is 3 and had to go in her swimsuit NO NOT THE POOL! SHe knew she had to go but I couldn't let her sit on that toilet! Its absolutely ridiculus! The probelm is not that we have the pool its the HOA. Many communties have pools without all this drama. | | | |

Alert | | Actually buzymom, the other communities are having just as many problems as we are. Read some of the other community boards and you will see we are not the only ones. In fact on one of our forums "outsiders swimming in our pool" there were people from cobblestone farms and the villages replying. Seriously though, those are your neighbors doing that. I don't live in DesertPassage, but I have family that does and I often go enjoy your pool with family. It's a great pool area and I think you guys need to police it yourselves. Try meeting your neighbors, ask them what street they live on. Do something to make sure people can be held accountable.

Alert | Police it ourselves?? Thats bull****. Isnt that what we pay our HOA for, almost $100 a month. What a ridiculous idea. Just what I have time for, to police the pool area. Between work and kids and cleaning and cooking and all that other crap. We pay them to maintain our community and the pool is included in that. If they want to pay me to police the pool area, then great!! There is a huge health issue with people pooping in OUR pool. The day that someone pooped in it, supposedly a 24 hr pool company came out and shocked the pool and the brilliant sales office, the genious's that they are did not even know about it and people were swimming in the pool the next day. When I brought this to their attention they said that no one was supposed to be swimming in it until Thursday, so they finally went and hung sings up. If people don't have pools in their communit,y too bad so sad for them. The only reason that there should be people outside our community swimming here is if they are here with family that does live here. If you don't have a key to get in , then don't come in. | | | |

Krzy..my husband and I tried many times to meet our neighbors. Some are very friendly and we know them but others are not so friendly and hermits. My husband is the type of person who talks to anyone and everyone. We even tried to plan a Fourth of July neighborhood party. Only like 3 people were interested. So what you suggest is easier said than done.
As for policing our pool, I suggest barb wire at the top of fences to discourage climbers; keyed locks to get into and out of the pool; and cameras to record all activity. | | Proud Momma of 2 beautiful boys!!! | |

I agree that something should be done. The barbed wire might discourage a little... as long as they don't try to cut it in the middle of the night. We haven't been swimming down there too much this year, but I'm hoping something will be worked out soon. I wonder if the HOA would try to charge to cover any new additions. If they couldn't even heat the pool in the spring because it was too expensive... | | | |

Alert | Ok, usually I do not reply to these but in this case I think I will. We have been living in Desert Passage for about a year now, therefore I have been dealing with some of the same things as you. However, some things to bear in mind. First, our HOA is not almost $100. It is only $82. When you take into consideration that communities like Senita charge $70/month and they have NOTHING, our $82 is a good deal. I stopped in the sales office the other day to ask about some of the things ppl are complaining about in regards to the pool. The guy in there (Ive come to find out he is the only one who knows what he is talking about) sat down with me and explained everything pretty well. As for adding to the fence. This is not the HOA's power, it has 100% to do with the city. The city told KB how it needed to be built. Second, the problem with trespassing is a problem everywhere, not just Desert Passage. The only things different about DP is that they are actively arresting people and charging them with trespassing. The police have made it part of their nightly patrols. This just started in the past week from what I am told. Things are being done, it just doesnt happen over night. Third, I find it funny that everyone has been complaining about the pool not being heated. It is NOT part of the HOA to heat the pool year around. If that is the impression you are under, then the wrong expecations were set. I am sure the HOA would have no problem heating the pool year around, however, would everyone be ok with paying an extra $50/month? I know I wouldnt. Something else you may be interested in hearing. The $82/month is actually calculated by taking the total costs of ammenities etc, and dividing it by the total number of lots allotted to DP. This number is 705. If you take a look around and notice that we dont even have 300 homes closed yet. Who is paying the fees for the additional lots? Here is your answer... KB. They are paying up to $500,000/yr just to keep our HOA down to $82. Now I have had some problems with KB just like everyone else. However, I am thankful that KB isnt backing out like most of the other builders. Has anyone taken a drive through Rancho lately? This is our 3rd home and 3rd HOA. It is by far the best. If this is your first home I understand this may be hard to understand. Just ask around and youll see what I am talking about. Instead of spending countless hours complaining on forums, take 5 min and educate yourself. You will sleep better at night. I promise! | | | |

Alert | Well since you have done som much research then you obviously care just as much as everyone else does, Does it not bug you at all that people swim in our pool that don't live here. I really don't give a crap about all the legalities and what not that they would have to go through in order to correct the problem, I just want them to fix it. I am a homeowner that pays a fee to have amenities in this community, and the pool is one of them. However when people are pooping in this pool and vandalizing the pool it puts mine and my childrens health at risk. Yesterday when we were at the pool there were about 10 children in the pool, all in their clothes and no parents, as we pulled up we saw their mom dropping them off and leaving the community. We approached them and told them that they were trespassing and that the cops were on their way and guess what, they all got out and walked out of our community!!! If the city told KB how to build the gate in our community pool then how come the other community pools here have higher gates, how come there's were different. I did a little resarch myself also. I contacted the Environmental Health Department for Pinal county and our community pool isn't even listed as being in their jurisdiction, but it should be, From what they can tell KB did not even get a permit from them to build the pool and they are supposed to be keeping daily logs and recording any instances at the pool along with the daily PH levels and bla bla bla. I have every right to complain as much as I want to about whatever I want to. I have talked to Deborah, the head honcho of our HOA many times and she informed me that all it would take is a simple proposal to the board of directors to extend the gate on that pool and that she has had it done to several other pools that she looks after, why It hasn't been done here I don't know, hence the reason for my frustration. Do you see how everyone has a different story? Do you see that at all? KB tells you something completely different thatn what the HOA tells me. | | | |

I was sitting in the pool the other day when a cop car rolled in and rolled right out???? How did he know that I wasn't a trespasser? This should not even be in our hands to call the police and decide who gets to swim in our pool and who doesnt. Alert | I just happened to look at this thread because we have had similar problems in Cobblestone for the past 3 years or so.
I might be able to shed a little light this...First, the sales office has absolutely NOTHING to do with your pool. Your HOA management company and board (which is probably one in the same) is who can correct this situation. They can, and should raise the height of the door, make sure it is locking and closing correctly, and that you can not reach around or over the top to unlock it. That was the problem we had. We had to reinforce the fencing on both sides of the door/gate because people were bending the metal and reaching in and opening the door! This will probably have to be discussed at an HOA meeting, and you will need to write to them to get it on the agenda, then the board will discuss the situation and have to come up with a solution, then they will vote on it, then it can get corrected...since you probably only have one meeting every month, don't expect to have anything done until after the next meeting. Any spending over a preset amount (usually around $200) must be voted on.....that's most likely why you haven't seen much done yet.
Second, as for the police...I, myself, have had to contact the police with some trespassing issues. What I was told was, unless they are caught vandalizing or doing something illegal, they will not do anything about trespassing unless you have "proper" signs and in ALL the correct places...there is a strict code for "No Trespassing" signs. Also, your community MUST have a person available to contact 24/7 by the police on every incident involving your community.
Unfortunatly, it is very complicated, but if your management company has been around for a while, they know how to get all this done. Our past management company was horrible, so we changed a few months back, and we are now working on getting this stuff all corrected.
